We have all become aware of the potential health hazards presented by the presence of mold, but did you know that mold when left unattended will actually eat the structure of your home or building? Mold needs three things to survive and thrive; moisture, heat or humidity, and a food source. Almost all building materials contain cellulose, the preferred food for mold growth.

In the wake of the 2004 and 2005 Hurricane seasons thousands of homes suffered extensive damage, some of the homes requiring repairs and many others complete roof replacements. Real estate buyers have become increasingly aware that a home with mold is to be avoided, or at very least to be considered a fixer upper. In either case it is bad news for sellers.

  
 

The insurance industry has insulated themselves from this issue in most cases limiting, or excluding mold related claims from home owner’s policies altogether.
  
The media constantly reports on the epidemic of indoor mold growth. Since the early to mid-1990s, lawsuits seeking recovery for personal injuries and property damages resulting from mold have been increasing, and some have resulted in huge verdicts in favor of claimants. Contractors are being sued for faulty workmanship that resulted in water intrusion leading to mold. Sellers of real estate as well as Real Estate Agents are being sued for non disclosure of mold issues that they may or may not have even been aware of.

Liability for mold growth in buildings is currently one of the most serious environmental and economic concerns facing the construction industry, property managers, buyers, sellers, and a host of others. Although Texas and California were the primary states where substantial numbers of mold claims were initiated, large numbers of claims have now been brought to all parts of Florida. The North American insurance industry estimates that within the past 10 years thousands of toxic-mold and property destruction lawsuits were filed in the United States and Canada. Unfortunately, the number continues to increase dramatically with no end in sight.
